By purchasing a service from "Dead Яinger Digital" via our Discord platform or website, you are entering into a binding agreement with these terms of service, committing to adherence with all applicable laws and regulations, particularly those of the United States. If you are not in agreement with any part of these terms, you are expressly prohibited from using or accessing our services and platforms.

Definitions

For the purposes of this agreement, "digital services" refers to any non-tangible, electronic product or service provided by "Dead Яinger Digital". "Work" refers to any service performed, product provided, or other related activities undertaken by "Dead Яinger Digital" on behalf of a client.

Distribution of Service

​

All buyers are recognized as our customers, placing the onus on them to protect the files they receive. Files from "Dead Яinger Digital" are strictly for personal use and should not be redistributed to other servers or communities. Trusted developers may receive these files if working on your server, but the original buyer is held accountable if these files are leaked. Consequences for such actions may include a ban from future purchases, legal action, and other remedies as deemed fit by "Dead Яinger Digital".

Rights Reserved by Dead Яinger Digital

 

Dead Яinger Digital retains the right to: (1) Decline work for customers found to have previously leaked assets or resources. (2) Terminate any ongoing work for reasons the Management team finds justifiable. (3) Retain any editable files (.PSD, .AI or similar) unless express permission is given by Dead Яinger Digital's Management Team. (4) Modify these Terms of Service at any point. Customers will be notified of such changes through announcements on our Discord server, or other means as deemed fit.

Gifted Products

 

If you are requested to remove our products from your server that you received as a gift, compliance is mandatory as per these terms. Upon receiving a gift from "Dead Яinger Digital", be aware that we reserve the right to revoke your entitlement to use them.

 

 

Awareness of Terms

 

It's your duty to peruse and comprehend these terms prior to purchasing. Claiming ignorance, such as "I wasn't aware of the terms," is untenable unless there was no feasible way for you to access them on both our website and Discord.

 

 

Unlawful Activities

 

Unlocking or ripping models is explicitly prohibited. Perpetrators will face immediate removal from "Dead Яinger Digital", and our associates will be informed. Such individuals will then be barred from acquiring any future products or services from "Dead Яinger Digital".

 

 

Indemnification

 

You agree to defend, indemnify, and hold harmless "Dead Яinger Digital" from and against any claims, damages, costs, and expenses, including attorneys' fees, stemming from or related to your utilization of our services or violation of this agreement.

 

 

Limitation of Liability

 

"Dead Яinger Digital" shall not be responsible for any consequential, indirect, or special damages resulting from the use or inability to use our services.

 

 

Termination of Access

 

"Dead Яinger Digital" reserves the right to terminate or suspend a user's access to our services under any circumstances deemed as a violation of these terms.

Governing Law

 

These terms shall be governed by and construed in accordance with the laws of the United States and the State of Wisconsin. Any disputes arising under these terms shall be resolved exclusively in the courts of the State of Wisconsin.
